Substantive examination:

A patent will only be granted after substantive examination by the Office. A request for examination should be filed prior to the expiry of three years from international filing date. The request shall only be deemed to be filed upon payment of the examination fee.

The examination fee shall be reduced by 50% where the international search report has been established by the Federal Service for Intellectual Property, Patents and Trademarks (Rospatent), or by 20% where the international search report has been established by any of the other International Searching Authorities. The annual fees shall be reduced by 50% where a notice about an open license is filed with the Office. The reduction shall apply as from the year following the year of publication of information on the notice.

Granting a Patent for Invention:

Grant fee: registration, publication and issuance of a patent – EUR 84

The applicant may, prior to publication of a patent application, convert the said application into a utility model application by filing a request to that effect. The utility model application may be converted into a patent application at any time before the decision to grant is taken. The converted application shall have the priority date of the initial application.
