In regard of the procedure of registration of the trademarks in Uzbekistan it is important to note that no trademark was acknowledged in Uzbekistan as well-known yet, however there were several attempts to do it.

As a well-known trademark can be recognized the mark for goods and services registered in the territory of Uzbekistan or protectable under Madrid Agreement on international registration of trademarks, as well as a non-registered trademark, which has acquired general notoriety among the relevant circles of people as a result of its active use.

The authorized agency for acknowledgement of the trademark as well-known is the Board of Appeal of the Agency of Intellectual Property.

The regulatory act under which the mark is recognized as well-known is the Rules of filing and examining of the Appeals by the Agency of Intellectual property as of 24.01.2009.

Application for recognition of the trademark as well-known

The basis for recognition of the trademark as well-known is the Application filed by an interested natural or juridical person.

The Application must contain the information on the day from which the trademark was used and the date from which the applicant considers his/her trademark to be well-known in the territory of Uzbekistan.

The applications on acknowledgement of the trademarks as well-known in the Republic of Uzbekistan are examined by the Board of Appeal within 2 months from the filing date.

The official fee for filing the Application is USD 1680 in case the owner of a trademark is a foreign citizen. The official fee for filing the Application is USD 158 in case the owner of the trademark is a Russian citizen.

About the intensive use of a trademark in the territory of Uzbekistan
the list of settlements where the goods for which the trademark is applied were sold
about the volumes of sales of such products
about the way of use of such trademark, including advertising and exhibiting goods and services, for which the trademark is applied
about the average annual number of customers of the goods
about the countries where a trademark is recognized as well-known
about the customers survey, conducted by the specialized independent agency with due regard to the recommendations made by the Agency of Intellectual Property.


The opinions (statements) of the inspection body on the production quality, distribution organizations, organizations and agencies for customers’ rights protection, declarations, quality certificates and other documents can serve as a prove of the long-term, continuous, intensive and large-scale use of the trademark.
