Kazakhstan
The importation of goods into Kazakhstan is regulated by the customs authorities. All imports are subject to mandatory customs control, which includes the verification of documents, the collection of duties and taxes, and the inspection of the imported goods themselves.
Customs control extends to trademarks that have been duly registered in Kazakhstan.
To record a trademark in the Customs Register, the relevant application must be filed, which should contain the following information:
- information about the owner of the IP object, including name and address, bank details, and officer and corporate position;
- notarized copies of the certificate of registration;
- description of the original products with an indication of product codes , at least at the level of the first six characters , in accordance with the EAEU CN of FEA;
- photographs and description of original products;
- photographs and description of counterfeit goods;
- the insurance contract;
- a commitment to compensate for damages and costs incurred by the customs authority upon suspension;
- an extract from the Kazakh PTO, which confirms the validity of the international trademark registration in the territory of Kazakhstan;
- a PoA, notarized and legalized.
The term for consideration of the application is 20 business days.
The maximum term of protection of the rights of the holder by the customs authorities is 2 years.
