Kosovo is not a Contracting State of the Patent Cooperation Treaty (PCT) and is not a member of the European Patent Convention (EPC). Therefore, PCT or European patent routes cannot be used to obtain patent protection in Kosovo.
There is no PCT national phase entry in Kosovo and no possibility to validate a European patent there. The only route is a direct national patent application, with or without Paris Convention priority, before the Kosovo Industrial Property Agency.
Practical implications for PCT applicants
Applicants who have filed an international PCT application and wish to protect their invention in Kosovo must file a separate national patent application within the 12 month Paris Convention priority period.
All standard national requirements apply, including local representation for foreign applicants, language and translation requirements, and payment of local fees. The term, maintenance, and SPC regime are the same as for directly filed national applications.
