    Georgia provides protection for new plant varieties through a national breeder’s rights procedure.

    Required documents
    For filing a PBR application in Georgia, the following documents are generally required:

    • application in the prescribed form with information about the variety, breeder, and applicant;
    • variety description covering the main morphological, biological, and botanical characteristics;
    • photographs of the variety;
    • copy of the employment contract, if the variety was developed in the course of employment;
    • copy of the priority application, if priority is claimed, together with a Georgian translation;
    • CPVO DUS report, if available;
    • power of attorney.

    Formalities and filing stage
    No notarization or legalization is required for the standard filing set. All documents are filed at the filing stage. After formal examination and publication, the application is transferred for testing to the accredited plant breeder within two weeks.

    Technical examination
    If the variety has already been tested abroad and a distinctness, uniformity, and stability report exists, SAKPATENTI may accept the foreign certificate and its Georgian translation. Otherwise, the technical examination is conducted through the local testing procedure.

    Protection term
    The protection term is 25 years from registration for most varieties and 30 years for grapevine, trees, shrubs, ornamental plants, tea, subtropical crops, and forest crops.
