    Tajikistan provides legal protection for plant varieties through a national breeder’s rights framework.

    Required documents
    For filing a PBR application in Tajikistan, the following documents are generally required:

    • application form;
    • technical questionnaire;
    • DUS report, if available;
    • power of attorney;
    • two copies of color photographs or illustrations of the plant and relevant parts, prepared in the required format;
    • assignment document, if the applicant is not the breeder.

    Formalities and document form
    All documents must be submitted in the local language or accompanied by a translation into the local language. The application is filed in paper form with the competent authority. The general procedure includes formal examination, publication, DUS examination, decision on grant, entry into the Register, and issuance of the certificate. The time frame from filing to grant typically ranges from approximately three to five years.

    Examination and samples
    A DUS report issued by a recognized foreign authority, including CPVO, may be taken into consideration by the authority in Tajikistan. However, acceptance is not automatic and remains subject to the discretion of the competent authority. In practice, a local DUS test or adaptation trial may still be required. The authority may also request plant material for examination, and the timing and quantity depend on the crop and the testing instructions issued after filing.

    Protection term
    The protection term is 20 years from the date of grant of the breeder’s right. For trees and grape varieties, the protection term is 25 years.
