    Plant breeders and rights holders can protect new varieties in Uzbekistan through the national PBR procedure.

    Required documents
    For filing a PBR application in Uzbekistan, the following documents are generally required:

    • application for a patent of the Republic of Uzbekistan, identifying the breeder and applicant and indicating the proposed name of the variety;
    • description of the breeding achievement, including the technical questionnaire;
    • photographs of the variety;
    • documentation relating to the breeding achievement trials carried out by the applicant;
    • applicant’s declaration confirming that the breeding achievement has not been used, sold, transferred, or otherwise made available in a way inconsistent with novelty requirements;
    • document confirming priority, if applicable, together with a Uzbek translation;
    • applicant’s undertaking to submit material for testing within the required time limit;
    • CPVO DUS report, if available;
    • power of attorney.

    Formalities and document form
    The power of attorney must be apostilled. The documents listed above are filed at the filing stage, and the power of attorney, declaration, and undertaking must be submitted in original form.

    Examination and samples
    If the applicant files a report on patentability examination from another country, the Intellectual Property Agency of Uzbekistan, following assessment by a local specialized agency, may either accept or reject it. If accepted, the Agency will take a decision on registration of the variety.

    If there is no external opinion on patentability, or if it is not accepted, the Variety Testing Commission will request that the applicant submit seeds or planting material in the required quantity for testing within the specified time period.

    The procedure for sending, receiving, and customs clearance of seeds is then carried out with the involvement of declarants. A quarantine committee subsequently evaluates the condition of the seeds. A positive report allows the seeds to be transported to a variety testing facility for planting, field trials, and growth monitoring.

    Protection term
    The protection term is 20 years from registration, and 25 years for grape varieties, tree crops, ornamental crops, fruit crops, and forestry species, including planting stock. The term may be extended by up to 10 years.
