Protectability criteria and exclusions
Utility models protect technical solutions, while basic exclusions and distinctions from patents follow the general EU approach. Patent standards are stricter, whereas utility models can cover simpler inventions that might be considered obvious under patent criteria.
Methods and certain subject matter categories may not be eligible, and utility models remain subject to invalidation if later found to lack novelty or inventive step.
Term and basic features
Compared with patents, the protection period for utility models is significantly shorter, typically around 7 to 10 years, without further renewal, and official fees are lower.
