Regional Industrial Design Patent in Eurasia

The Eurasian Patent Organization (EAPO) accepts applications for industrial designs from June 1, 2021.

The Eurasian design patent will be valid for the following members of the Eurasian Patent Convention (EAPC): Armenia, Azerbaijan, Kazakhstan, Kyrgyzstan and Russia.

The Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention, adopted on September 9, 2019, previously ratified by the participants of the EAPC, was entered into force on March 17, 2021.

For Applicants who need a one-time legal protection for their design in each or several of the mentioned EAPC member states, the new regional patent provides a simplification of the procedure, through the so-called “one window”, which will significantly optimize the time frame and financial implications for obtaining a protection document (patent).

It is worth noting that the registration procedure of the Eurasian industrial design foresees a mandatory substantive examination, which is aimed at determining the compliance of the claimed design with such patentability criteria as “novelty” and “originality”.
